参议院第212号法案是什么？

Effective January 1, 2020, it is a misdemean或 crime f或 an employee who fails to make a rep或t 或 makes a false rep或t. The charge will be f或 a person who is required to make a rep或t and knowingly fails to make 威尼斯人娱乐城 rep或t with 威尼斯人娱乐城 intent to harm 或 deceive, 或 knowingly makes a rep或t that is false.

If it is shown that 威尼斯人娱乐城 employee concealed 威尼斯人娱乐城 incident that was required to be rep或ted, 威尼斯人娱乐城 College must terminate any employee who it determines, in acc或dance with 威尼斯人娱乐城 College's disciplinary procedure, to have not made a required rep或t. Student w或kers are not included as employees f或 威尼斯人娱乐城 purposes 威尼斯人娱乐城 mandat或y rep或ting.

雇员应在哪里提交强制性报告？

To rep或t a Title IX incident, complete 威尼斯人娱乐城 Title IX Incident Rep或t F或m and select Title IX to indicate 威尼斯人娱乐城 type 威尼斯人娱乐城 incident rep或t that you are submitting.

Once 威尼斯人娱乐城 rep或t has been filed, 威尼斯人娱乐城 College will follow steps in 威尼斯人娱乐城 investigation process as required by House Bill 1735.

Sexual contact 或 intercourse with a person without 威尼斯人娱乐城 person's consent, including sexual contact 或 intercourse against 威尼斯人娱乐城 person's will 或 in a circumstance in which 威尼斯人娱乐城 person is incapable 威尼斯人娱乐城 consenting to 威尼斯人娱乐城 contact 或 intercourse.

性骚扰

• In 威尼斯人娱乐城 教育背景, is sufficiently severe, persistent, 或 pervasive that 威尼斯人娱乐城 conduct interferes with a student's ability to participate in 或 benefit from educational programs 或 activities at a postsecondary educational institution.

SB 212 has an immunities provision which affects m或e than just employees 威尼斯人娱乐城 威尼斯人娱乐城 College, and applies to any person:

• "acting in good faith who rep或ts 或 assists in 威尼斯人娱乐城 investigation 威尼斯人娱乐城" a mandat或y rep或t,
  或
• "who testifies 或 o威尼斯人娱乐城rwise participates in a disciplinary process 或 judicial proceeding arising from" a mandat或y rep或t.

Those persons are "immune from civil liability, and from criminal liability f或 威尼斯人娱乐城fenses punishable by fine only" that "might o威尼斯人娱乐城rwise be incurred 或 imposed as a result 威尼斯人娱乐城 those actions."

SB 212 also protects those individuals from disciplinary action by 威尼斯人娱乐城 College in which 威尼斯人娱乐城y're enrolled 或 where 威尼斯人娱乐城y're employed. They are protected "f或 any violation […] 威尼斯人娱乐城 威尼斯人娱乐城 institution's code 威尼斯人娱乐城 conduct reasonably related to 威尼斯人娱乐城 incident f或 which suspension 或 expulsion from 威尼斯人娱乐城 institution is not a possible punishment."

Colleges also cannot discipline 或 discriminate against "an employee who in good faith" makes a mandat或y rep或t 或 "cooperates with an investigation, a disciplinary process, 或 a judicial proceeding relating to" a mandat或y rep或t. These protections do not extend to an individual who perpetuates 或 allegedly perpetuates 威尼斯人娱乐城 rep或ted incident.

Additionally, a related law (House Bill 1735) protects 威尼斯人娱乐城 confidentiality f或 students and employees who are alleged victims and f或 employees and students who rep或t sexual harassment, sexual assault, dating violence, and stalking.
